Funding the Fight: Building Our Defenses to Stop J7

Over the last two years, our community has stood shoulder to shoulder to oppose the proposed J7 Ready Mix concrete batch plant. Together, we’ve written letters, filed hearing requests, attended meetings, and raised awareness. And because of those efforts, we’ve made real progress.
Recently, the Texas Commission on Environmental Quality (TCEQ) confirmed that a contested case hearing has been granted for the J7 Ready Mix air quality permit. This is a huge step forward — and it’s all because of you. Every email, every public comment, and every donation helped us get here.
But we’re not done. In many ways, this is where the real battle begins.
Where Things Stand Now
We don’t have an exact hearing date. It could be held later this year or sometime next year. The schedule is ultimately decided by the State Office of Administrative Hearings (SOAH), which will assign a judge and set the timeline.
While we wait for that date, our legal team is preparing to build the strongest possible case on behalf of the community. That means bringing in expert witnesses who can provide hard data on how the proposed plant would affect:
Air quality – including particulate matter, emissions, and downwind exposure.
Public health – particularly for children, elderly residents, and people with asthma or respiratory issues.
Plant and animal life – including the long-term environmental impact on soil, vegetation, and wildlife.
Dust control and runoff – which can spread beyond the site and affect surrounding properties.
These experts are critical. They translate our community’s concerns into the technical, scientific, and legal language that the court requires. Their work can make or break the outcome.
What It Will Take
Our attorney, who is one of the top environmental attorneys in Texas, and the same one who helped stop the plant off Bennett Lawson Road in Rendon, has advised that we should have $100,000 raised by November 1 to be fully prepared.
That amount covers legal fees, expert witness retainers, and case preparation. Without those funds, we risk being underrepresented when the hearing begins.
To be clear: the hearing itself is not in November.
The November 1 deadline is the attorney’s target for having funds in place before deadlines hit. Preparation takes time, and we can’t afford to wait until dates are announced to start raising money.
Why It Matters
J7 Ready Mix is betting that we’ll lose momentum. They are betting that after two years of fighting, we’ll run out of energy or funds. But this community has proven time and time again that we don’t give up.
This fight is about more than one permit. It’s about protecting our homes, our air, our health, and our local environment from long-term harm. Once a plant like this is approved, the impacts are nearly impossible to undo.
