Update: OPIC Recommendation on J7 Ready Mix Permit

You may have received another letter in the mail from the Texas Commission on Environmental Quality (TCEQ). This one comes from the Office of Public Interest Counsel (OPIC).


HERE'S WHAT IT MEANS:

  1. OPIC has reviewed our community’s hearing requests.

  2. They are recommending that the Commissioners grant those requests and send some of the issues (are relevant and material to the Commission’s decision regarding this Application) to the State Office of Administrative Hearings (SOAH).

  3. If the Commissioners agree, the permit fight moves into a formal, trial-like process before an administrative law judge. That process can take up to 180 days.


DO YOU NEED TO DO ANYTHING RIGHT NOW?

No — if you already submitted a request, you are officially on record. Nothing has changed in terms of what you need to do.


WHAT HAPPENS NEXT?

September 24, 2025 – The three TCEQ Commissioners will meet and decide whether to:

  • Approve the permit,

  • Deny the permit, or

  • Send it to SOAH for a contested case hearing (as OPIC recommends).


WHY THIS MATTERS:

If the case is sent to SOAH, this fight becomes much more expensive. Based on estimates, it could cost $100,000–$120,000 for both sides to fully argue it.
